Citation Nr: 18131267 Decision Date: 08/31/18 Archive Date: 08/31/18 DOCKET NO. 11-28 753 DATE: August 31, 2018 REMANDED Entitlement to a rating in excess of 10 percent for residuals of a right tibia stress fracture is remanded. REASONS FOR REMAND The Veteran had active service from July 1976 to May 1977. This case is before the Board of Veterans’ Appeals (Board) on appeal from a rating decision of a Department of Veterans Affairs (VA) Regional Office (RO). This case was last before the Board in September 2017, when it was remanded for additional development. Entitlement to a rating in excess of 10 percent for residuals of a right tibia stress fracture is remanded. The evidence indicates there may be outstanding relevant VA treatment records. A March 5, 2018 VA treatment record indicates that the Veteran was to return for a follow up in September 2018. To date, VA treatment records subsequent to June 14, 2018 have not been associated with the claims file. Additionally, a February 23, 2016 VA treatment record indicates that unidentified fee basis emergency room records from “Charleston County ES” had been scanned into VistA Imaging. It does not appear that record has been associated with the claims folder. A remand to obtain the outstanding record and any updated VA treatment records is required. The matter is REMANDED for the following actions: Ask the Veteran to provide the names and addresses of all medical care providers who have recently treated him for his residuals of a right tibia stress fracture. After securing any necessary releases, request any relevant records identified. In addition, obtain updated VA treatment records dated since June 14, 2018 as well as the VistA Imaging records referenced in the February 23, 2016 VA treatment record. If any requested records are unavailable, the Veteran should be notified of such. K. A. BANFIELD Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD J. Jenkins, Counsel
